Is an 11-month rent agreement required to be registered in Delhi?

Leases for more than one year must be registered under Section 17 of the Registration Act. An agreement for eleven months or less is commonly not registered, but it must still be executed on stamp paper of the correct value under the stamp law applicable in Delhi.

Are electronic signatures valid on contracts?

Yes. Under the Information Technology Act, 2000, contracts formed electronically and signed with valid electronic signatures are generally enforceable. Some documents, such as wills, powers of attorney and conveyances of immovable property, are excluded and still need physical execution.

Is a non-compete clause enforceable in India?

A restraint that applies during the term of employment or a business relationship is usually enforceable. A restraint after the relationship ends is generally void under Section 27 of the Indian Contract Act, except in limited cases such as the sale of goodwill.

What happens if an agreement is not stamped?

An insufficiently stamped document cannot be relied on as evidence until the deficient duty and penalty are paid. The Supreme Court has held that such documents are not void and the defect is curable, but it is better to stamp correctly at the time of signing.
