| Above 1 year up to 5 years | Average annual rent | 2% |
| Above 5 years | Average annual rent or a multiple of it | Conveyance rate; get it checked |
Average annual rent is the total rent for the whole term divided by the number of years. Recurring charges the tenant must pay to the owner under the agreement count as rent. A premium or non-refundable advance attracts separate duty.

When registration is compulsory
A lease for more than one year, from year to year, or reserving a yearly rent must be registered under Section 17(1)(d) of the Registration Act, 1908 and Section 107 of the Transfer of Property Act, 1882. An unregistered lease of that kind cannot be used to prove its terms in court. Registration and pasting fees are paid at the Sub-Registrar in addition to stamp duty. If a party cannot attend, they can act through a power of attorney.

Frequently asked questions
How is stamp duty on a rent agreement calculated in Delhi?
For a lease of up to five years, stamp duty is 2% of the average annual rent. Average annual rent is the total rent payable over the term divided by the number of years. For an agreement of one year or less, it is calculated on the total rent payable.
How much stamp duty is payable on an 11-month rent agreement in Delhi?
2% of the total rent for the 11 months. For a monthly rent of ₹25,000, the total is ₹2,75,000 and the stamp duty is about ₹5,500.
Is security deposit included in stamp duty?
A refundable security deposit is generally not treated as rent. A premium, fine or non-refundable advance attracts separate duty under Article 35. Check how your agreement describes the deposit before buying the e-stamp.
Does rent escalation affect stamp duty?
Yes. The average annual rent is worked out on the total rent payable over the whole term, including agreed increases. Enter the annual increase in the calculator to include it.
Is registration needed after paying stamp duty?
Only if the lease is for more than one year, from year to year, or reserves a yearly rent. Such leases must be registered at the Sub-Registrar. An 11-month agreement only needs proper stamping and is usually notarised.
What about leases above five years?
Leases above five years attract duty at the conveyance rate on the average annual rent, or a multiple of it for longer terms, and must be registered. Get the figure checked for your term before buying the e-stamp.
This calculator gives an estimate for leases of up to five years based on Article 35 of Schedule I-A of the Indian Stamp Act as applicable to Delhi. Confirm the duty before buying the e-stamp.
