What is the time limit to recover money?

Generally three years from when the amount became due. A written and signed acknowledgment of the debt before expiry, or a part-payment, can extend the limitation period under Sections 18 and 19 of the Limitation Act.

What is a summary suit?

A summary suit under Order XXXVII CPC is a fast-track procedure for liquidated money claims based on written contracts, bills of exchange, promissory notes or cheques. The defendant can defend only after obtaining leave of the court.

Can I claim interest on the amount?

Yes. Interest can be claimed at the contractual rate, or at a reasonable rate awarded by the court under Section 34 CPC for the period before the suit, during the suit and until payment.
