What makes the will valid
- You must be an adult of sound mind (Section 59, Indian Succession Act, 1925).
- Sign the will yourself, or by your mark, in front of two witnesses (Section 63).
- Both witnesses must sign in your presence.
- No stamp paper is needed, and registration is optional.
- Do not use a beneficiary or their spouse as a witness; the gift to them becomes void (Section 67). The tool warns you if a witness name matches a beneficiary.
After you generate the will
- Read every line and replace any [BRACKETED] text.
- Describe each property in full: address, khasra or plot number, account or folio numbers.
- Print on plain paper, sign every page, and have both witnesses sign the last page.
- Consider registering it with the Sub-Registrar; a registered will is much harder to challenge.
- Tell your executor where the original is kept.

- You have property abroad or are an NRI.
- You want to create a trust or life interest for someone.

Frequently asked questions
What is the format of a will in India?
A will in India usually has a declaration of sound mind, a clause revoking earlier wills, the appointment of an executor, the list of bequests, a residuary clause, the date and place, and the signatures of the testator and two witnesses.
Does a will need to be on stamp paper?
No. A will can be written on plain paper and no stamp duty is payable. Only the registration fee applies if you choose to register it.
Is a will valid without registration?
Yes. Registration is optional under the Registration Act, 1908. A properly signed and attested will is valid, though registration makes it harder to challenge.
Can a beneficiary be a witness to a will?
A beneficiary can sign as a witness, but the gift to that witness or their spouse becomes void under Section 67 of the Indian Succession Act. Use independent witnesses.
Can I make a will online with this tool?
The tool creates the text of a will. It becomes a will only when you print it, sign it, and have it attested by two witnesses as required by Section 63.
Can I change my will later?
Yes. You can change it at any time by a codicil or a new will. The latest valid will prevails.
