What is an affidavit?

An affidavit is a written statement of facts that the person making it (the deponent) swears or affirms to be true before an authorised officer, such as an Oath Commissioner or a Notary Public. Making a false statement in an affidavit is an offence of giving false evidence under the Bharatiya Nyaya Sanhita, 2023, so state only facts you know to be true.

  3. Print the affidavit on the e-stamp paper, or attach it to the e-stamp certificate.
  4. Sign in front of an Oath Commissioner or Notary, who will attest it with a seal.
  5. Carry your original ID, as the officer will verify your identity.

Oath Commissioners sit at every Delhi district court complex, such as Rohini Court. Notaries are also available near court complexes and sub-registrar offices.

Affidavits filed in court

Affidavits filed in a court case, such as an affidavit in support of a plaint, an application or evidence by affidavit, follow the court’s format: the case title appears at the top, and the verification refers to the paragraphs based on personal knowledge and those based on legal advice or records. These are best drafted by a lawyer, because a defective affidavit can lead to objections or adverse findings.

Common mistakes to avoid

  • Leaving bracketed text or blanks in the final copy.
  • Mixing several facts in one paragraph.
  • Stating facts you do not personally know as if you do.
  • Wrong name spellings compared with your ID documents.
  • Signing before the Oath Commissioner or Notary is present.
